Chapter 7 Bankruptcy
The most common form of bankruptcy filing, Chapter 7 is typically referred to as the liquidation chapter. A quicker process than Chapter 13, the successful liquidation of your non-exempt assets can result in a discharge of your debts, paving your way for a fresh start.
Important note: In a no-asset Chapter 7 case, you keep all of your property.
Chapter 13 Bankruptcy
Chapter 13 is often referred to as a reorganization bankruptcy. This means you'll be responsible to pay back some or all of the debts you owe to your creditors over a specific period of time.
There are many variables that contribute to a decision to file for Chapter 13 instead of Chapter 7. For example, this is an appealing alternative for those who have non-exempt property they want to keep.
